On Tuesday, a 17-year- old girl was allegedly gang-raped by her father, brother and uncles in Dhandheda village of Muzaffarnagar for running away with her lover. The rapists were arrested after the girl reported them.
After the complaint was filed the police booked the accused under section 376 D (gang rape) of the IPC. The investigation is still going on.
The case started in August this year when the girl’s family took her lover to court. However, when she testified that she had eloped voluntarily the court dismissed all charges against him.
The girl eloped with him again in October prompting another complaint. Subsequently, she appeared before the Allahabad High Court claiming that she had been gang-raped by members of her own family and was forced to abort her unborn child.
The High Court on 18 th November ordered the police to file an FIR under specific sections of IPC related to gang-rape. A FIR was filed on 19 th November followed by the arrest of the accused next day.
At the court’s bidding the victim’s father Haakim, her brother Saabir and her two uncles Sameen and Aashu have been arrested under sections 376 D(gang rape), 504 ( intentional insult with intent to provoke breach of the peace), 506 (criminal intimidation), 323 (voluntarily causing hurt) and 313 ( causing miscarriage without woman's consent) of the IPC.
